Sept. 3, 2024 NOTICE: The Probate Court is under construction, but is open and accepting filings.
We will temporarily be located in the Family Court offices on the garden level of the courthouse.
Office hours are 8-5, Monday through Friday. If you would like more information or would like to participate in or view a Zoom proceeding, please email probatecourt@allegancounty.org or call (269) 673-0250.
Please direct your filings and inquires to probatecourt@allegancounty.org. Often filing fees are still required. Please visit ALLPAID and if asked, use code 7299. No fax/e-mail (digital) filing in excess of 20 pages, including exhibits, will be accepted. Thank you for your understanding. COVID 19 UPDATE: The Allegan County Courts continue to follow the recommendations of the Allegan County Health Department.
- Masks will no longer be required in any courtroom or hearing room unless social distancing can not be maintained.
- The Courts will continue to rely upon updates from the Allegan County Health Department for continued safe operation and modify their practices accordingly.
Remote participation in court proceedings will continue to be practiced as deemed appropriate.
About the Probate Court
The Probate Court has jurisdiction over the following matters:
- Deceased Estates
- Trusts
- Guardianships for Minors and Adults
- Conservatorships for Minors and Adults
- Mental Health Proceedings
- Delayed Registrations of Foreign Birth
- Drain Appeals
The Probate Court also handles a variety of other matters. These include the following:
- Petitions for Protective Orders, which are typically one-time requests for the Court to allow or approve some action, such as approval of a settlement.
- Various civil actions, in which one party is suing another party. These cases are just like cases in circuit or district court, except usually a trust, estate, or fiduciary is one of the parties, so the proceeding has some relation to the regular business of the Probate Court.
- Finally, the Probate Court holds Wills for safekeeping and handles drain appeals and secret marriages.
Goals
- To process all matters within the time guidelines set by the State Court Administrative Office
- To ensure the compliance of Court-appointed fiduciaries with statutes and courts rules, in order to safeguard protected individuals and their property
- To efficiently process and adjudicate all matters before the Court
- To provide excellent customer service to all those with business before the Court
Our Mission
The mission of the Allegan County Probate Court is to administer justice with fairness, equality, and integrity, to resolve matters before the court in a timely manner, and to provide courteous and prompt service in a manner that inspires trust and confidence.
