The Allegan County Probate Court adjudicates conservatorship proceedings for minors and adults.

Minor Conservatorships

The Court may appoint a conservator or enter a protective order for a minor when a minor owns money or property that requires management or protection that cannot otherwise be provided, has or may have business affairs that may be jeopardized or prevented by minority, or needs money for support and education and that protection is necessary or desirable to obtain or provide money. MCL § 700.5401(2).

Adult Conservatorships

The Court may appoint a conservator for individual who is mentally competent, but due to age or physical infirmity is unable to manage his or her property and affairs effectively and who, recognizing this disability, requests a conservator's appointment. MCL § 700.5401(4).

Alternatively, the Court may appoint a conservator for an adult if the Court finds that:

  • the individual is unable to manage property and business affairs effectively for reasons such as mental illness, mental deficiency, physical illness or disability, chronic use of drugs, chronic intoxication, confinement, detention by a foreign power, or disappearance, and
  • the individual has property that will be wasted or dissipated unless proper management is provided, or money is needed for the individual's support, care, and welfare or for those entitled to the individual's support, and that protection is necessary to obtain or provide money. MCL § 700.5401(3).

Below are the forms that must be completed to commence a conservatorship/protective order proceeding for a minor or an adult in the Allegan County Probate Court. Once you have completed these forms, you may file them in person or mail them to the address listed to the left of this page. Please note that the Criminal History Authorization Form is not required to file a Petition for Protective Order. The filing fee to commence a conservatorship proceeding is listed below.

Memorandum re Guardian Ad Litem Fees
The Allegan County Probate Court has adopted the following policy concerning payment of guardian ad litem fees. Michigan law requires that a guardian ad litem be appointed to safeguard the interest of the person for whom the guardianship/conservatorship is being sought. Payment of the guardian ad litem fees are the responsibility of the Petitioner, unless otherwise prearranged with the Allegan County Probate Court. Please be prepared to pay the guardian ad litem visitor on the date of your hearing. Fees for this service typically range between $150.00 and $200.00. This is separate and distinct from the filing fee.  The filing fee is due at the time of filing, the Guardian Ad Litem fee is due at the court hearing.
