Minor and Adult Conservatorships - Annual Account

Each year a conservator of a minor or a legally incapacitated individual must file:

  • An accounting each year within 56 days after the anniversary of his or her appointment, using the Account of Fiduciary (PC 584).
  • A Proof of Service form (PC 564) indicating which interested persons were served with a copy of the Account. MCR 5.409(C).

In a minor conservatorship, if the assets were ordered to be placed in a restricted account, the conservator is required to file a Proof of Restricted Account form (PC 669) within 28 days after the anniversary of his or her appointment. MCR 5.409(C)(4).

Minor Guardianships - Annual Report

A guardian of a minor must file a written report each year within 56 days after the anniversary of his or her appointment, using the Annual Report on Condition of Minor (PC 654). A Proof of Service form (PC 564) must also be filed indicating which interested persons were served with a copy of the Report. MCR 5.409(A).

LII Guardianships - Annual Report

A guardian of a legally incapacitated individual must file a written report each year within 56 days after the anniversary of his or her appointment, using the Annual Report on Condition of Legally Incapacitated Individual (PC 634). A Proof of Service form (PC564) must also be filed indicating which interested persons were served with a copy of the Report. MCR 5.409(A).

DD Guardianships - Annual Report and/or Account

A guardian of a developmentally disabled individual must file a written report each year within 56 days after the anniversary of his or her appointment, using the Report of Guardian on Condition of Individual with Developmental Disability form (PC 663). If a standby guardian has been appointed, he or she must sign the Statement by Standby Guardian at the bottom of the second page of the report. If the guardian has been appointed over the individual’s estate, he or she must also file the Account of Fiduciary (PC 584). A Proof of Service form (PC 564) must also be filed indicating which interested persons were served with a copy of the Report and/or Account. MCR 5.409(A).

Deceased Estates - Notice of Continued Administration

If the personal representative is unable to complete the administration of the estate within one year of the original personal representative’s appointment, he or she must file with the court and all interested persons a notice that the estate remains under administration, specifying the reason for the continuation of the administration. Using the Notice of Continued Administration Form (PC 587), the personal representative must give this notice within 28 days of the first anniversary of the original appointment and all subsequent anniversaries during which the administration remains uncompleted. A Proof of Service form (PC 564) must also be filed indicating which interested persons were served with a copy of the Notice. MCR 5.307(C).
