Public Act 138 of 1989, as amended by Public Act 069 of 2005, by resolution of the county board of commissioners of the county, as provided in part 115 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.11501 to 324.11550, may impose a surcharge on households within the county of not more than $2.00 per month or $25.00 per year per household for waste reduction programs and for the collection of consumer source separated materials for recycling or composting including, but not limited to, recyclable materials, as defined in part 115 of the natural resources and environmental protection act, 1994 PA 451, MCL 324.11501 to 324.11550, household hazardous wastes, tires, batteries, and yard clippings.  If approved by the voters of a participating unit of government, a county may charge an amount no more than $4.00 per month or $50.00 per year per household.  The Urban Cooperation Act of 1967 allows Michigan counties, townships and municipalities to enter into interlocal agreement.

Local units of government in Allegan County are considered potential participants, current participants on discretionary $25 surcharge, or current participants on the voted surcharge.

Potential Participants: Local units, not currently participating in the Resource Recovery Program, may join the program by participating in an Board of Commissioners authorized election for a $50 surcharge or adopting a discretionary surcharge without an election ($25.00/household/year as authorized by Public Act 138 of 1989).

Current Participants on discretionary $25 surcharge: Local units currently participating in the Resource Recovery Program and collecting a $25/household/year.  Residents may ‘opt-out’ of the discretionary surcharge by contacting their local unit of government.

Current Participants on the voted surcharge:  Local units that operate under a voted surcharge are obligated to an initial five year collection period or subsequent ten year collection period.  Voter approved recycling surcharge is compulsory.

Those local units collecting the recycling surcharge, collection occurs on winter property taxes.

The recycling surcharge is utilized to fund recycling services in this priority order:

  1. Curbside pick-up and or drop-site collection recycling programs within the participating local unit of government.

  2. Tire collections, appliance collections, composting, household battery collection, household hazardous waste collection, electronic device collection, and other services allowed under Act 138, P.A. 1989.
